11th Meeting of the Council of ASEAN Chief Justices, First ASEAN Insolvency Judges Meeting, 2nd ASEAN+ Meeting

The 11th Meeting of the Council of ASEAN Chief Justices (“CACJ”) took place on 20 November 2024. In conjunction with that meeting, the First ASEAN Insolvency Judges Meeting and the 2nd ASEAN+ Meeting took place on 19 November 2024.

11th CACJ Meeting

The Supreme Court of the Philippines hosted the meetings at the Shangri-La Mactan, Cebu. The Hon. Alexander G. Gesmundo, the Chief Justice of the Supreme Court of the Philippines, was elected as Chair of the CACJ at the opening of the 11th CACJ Meeting.

The CACJ held wide-ranging discussions on key issues such as:

  1. Increasing efforts to support and promote judicial education and training, including new methodologies and self-learning e-courses;
  2. Publishing an ASEAN Memorandum of Guidance on how ASEAN judiciaries recognise and enforce foreign money judgments;
  3. Considering the use of social media by the CACJ as an additional platform for engagement with the public;
  4. Administrative verification of court orders relating to the care of a child made by a court of another ASEAN member state;
  5. Simplified protocol to verify the authenticity of court orders within ASEAN;
  6. Adoption of the Blueprint for Taking Preparatory Steps towards Establishing a Signature Programme to Identify and Develop Young ASEAN Judicial Leaders, the Model Protocol for Court-to-Court Communications and the Model Social Media Guidelines; 
  7. Having a CACJ Working Week during which Working and Study Group meetings can be convened within the same week; and
  8. Establishing a CACJ-ASEC Standing Interface as part of the CACJ’s efforts to develop a dialogue with the ASEAN Secretariat.

At the close of the meeting, all attending Chief Justices and Heads of Delegations signed the Cebu Declaration.

On 19 November 2024, the Chief Justice of the Supreme Court of the Philippines, The Hon. Alexander G. Gesmundo, launched the CACJ Commemorative Publications featuring compendiums of agreed frameworks of good practices from various CACJ Working Groups. The Supreme Court of the Philippines also hosted a Welcome Dinner on 19 November 2024, and a Gala Dinner on 20 November 2024.

First ASEAN Insolvency Judges Meeting

The First Meeting of ASEAN Insolvency Judges was held on 19 November 2024, on the sidelines of the 11th CACJ Meeting held in Cebu, the Philippines. Organised by the Singapore Judiciary and hosted by the Philippines Judiciary, the meeting was attended by Insolvency Judges from all ASEAN Member States, bringing with them their subject matter expertise. The meeting fostered an understanding of the framework for insolvency and restructuring in the respective ASEAN jurisdictions and provided a forum for an exchange of experiences and perspectives on dealing with cross-border insolvency matters, which led to an initial assessment of potential areas for collaboration.  A Standing Meeting of ASEAN Insolvency Judges was thereafter approved by the CACJ.

2nd ASEAN+ Meeting

The 2nd ASEAN+ Meeting between the CACJ and the judiciaries of the People’s Republic of China, Japan and the Republic of Korea, was held in hybrid-format on 19 November 2024. The theme for the meeting was “The Use of Court Technology to Enhance Access to Justice”. The meeting concluded with a proposal to establish formal collaboration between the CACJ and the judiciaries of the People’s Republic of China, Japan and the Republic of Korea in the area of court technology.
